All Indian Bar Association moved to PM for amending the old British law which restricts Indians to file any lawsuits against any foreign state.


THE NEWS

The Chairman of AIBA and Senior Advocate Dr. Adish Aggarwal has written a letter to Prime Minister Narendra Modi, in which he appeals to amend the outdated section 86 of Civil Procedure Code (CPC) 1908. So that Indians may get opportunity to ask for justice and sue Chinese government for their unethical deeds.


THE STORY

We all have seen what happened in China during the outbreak of covid19, facts were hide, they manipulated whole world by claiming that the virus may formed through a series of random events happened at seafood market of Wuhan.
But the truth is different from the story that China told the world, virus was synthesized on the orders of the Chinese government at the Wuhan institute of virology. Later the staff carelessly dealt with it, and it got exposed and within few months whatever happed everyone knows, it became a pandemic.

The surety came after the allegations came from US President Donald Trump’s public speech.

IMPACT

Many hundred thousands of people have died from this virus and world economy fell face down, even the world’s most powerful nations have wrecked. 

JUSTICE 

Everyone want justice but by fair means. So they are going to sue Chinese government. In this matter US is the first country where legal lawsuit started  filing against china. For that, they have amended their law to sue foreign state.

India is on the same track, our old law doesn’t allow us to file complain against china or Chinese government. So, Dr. Adish came forward for us and requested PMO to amend the aforesaid section. 



THE CONVENTION 

United Nations Convention on jurisdictional Immunities of states and their properties, its a policy of UN which gives immunity from being sued in any foreign court. India have signed the convention but didn’t ratified it. And as per this convention, it won’t come into affect until it get signed and ratified by the nation.

Indian have signed the convention in 2007 but didnt ratified it. So, we can sue Chinese government after the amendment come in force.



PAY BACK

Time has come now china has to answer and pay back for whatever the losses have done, and we have enough evidence now against Chinese government so we can easily drag them to court, and ask for justice and our reparation.

A number of people lose their lives and people gave up their livelihoods, small businesses have been closed, they got fired, unemployment struck country very hard no one is left unaffected, somewhere and somehow pandemic wounded every people of the nation. But India won't back off, India will rise again.

We can’t say China will pay in the coming years if we sue their government, because when you walk on the path of seeking justice, you can’t say how much time will it take and what you will get in the end.

Quest for justice is the attribution of fighter.
